2. Personal Data We Collect
Depending on how you interact with us, we process the following categories of personal data:
- Contact and enquiry data: your name, email address, telephone number if provided, company or professional details, and the information included in your message.
- Business correspondence: communications concerning quotations, equipment, rentals, production projects, technical support and any resulting business relationship.
- Technical data: IP address, browser and device information, requested pages, access dates and times, and diagnostic or security information generated when you use the website.
- Analytics and preference data: cookie identifiers, website interaction data and records of your cookie choices, as described below.
We collect information directly from you when you submit a form or contact us. Technical information is generated when your browser accesses the website. Analytics information is collected only after you give the relevant consent.
Please do not include sensitive personal information, identity documents or information about other individuals in an enquiry unless it is necessary for your request.
3. Purposes and Legal Bases
We process personal data for the following purposes:
- Responding to enquiries and preparing quotations. Where you request steps before entering into a contract with us personally, processing is based on Article 6(1)(b) GDPR. For general enquiries and communications with representatives of businesses, processing is based on our legitimate interest in responding to requests and conducting business communications under Article 6(1)(f) GDPR.
- Managing contracts and providing services. Processing is based on Article 6(1)(b) GDPR where you are a party to the contract. When you act on behalf of a business, we process your professional contact details under Article 6(1)(f) GDPR to manage that business relationship.
- Operating and protecting the website. We process necessary technical information under Article 6(1)(f) GDPR for our legitimate interests in maintaining website availability, diagnosing faults and preventing misuse.
- Measuring website use through Google Analytics 4. Processing is based on your consent under Article 6(1)(a) GDPR.
- Complying with legal obligations. Where applicable, processing necessary for accounting, tax obligations or lawful requests from competent authorities is based on Article 6(1)(c) GDPR.
- Establishing, exercising or defending legal claims. Necessary processing is based on our legitimate interest in protecting our legal rights under Article 6(1)(f) GDPR.
Where we rely on legitimate interests, we assess the necessity of the processing and its impact on your rights and freedoms.
Submitting an enquiry does not subscribe you to marketing communications. Any optional marketing subscription will be covered by a separate notice and consent request where required.
4. Whether You Must Provide Personal Data
Providing personal data through the website is voluntary. However, we need the required contact information to respond to your enquiry. If you do not provide it, we may be unable to handle your request.
Optional information is not required to submit an enquiry. Consent to analytics is also optional: refusing or withdrawing it does not prevent you from browsing the website or contacting us.
Reading this Privacy Policy or continuing to browse the website does not constitute consent to optional processing.
5. Cookies and Google Analytics 4
The website may use strictly necessary cookies or similar technologies to provide requested functions, maintain security and remember your privacy choices. These technologies do not require consent where they meet the applicable legal exemption.
With your prior consent, we use Google Analytics 4, a service provided by Google, to understand how visitors use the website and improve its content and functionality. Analytics information may include pseudonymous identifiers, page views, interactions, browser and device information, referral sources and approximate geographic information.
Google Analytics uses first-party cookies, including _ga and _ga_<container-id>, to distinguish browsers and maintain session information. These cookies have a default expiry of two years, which may be refreshed or shortened according to the implemented configuration.
The analytics configuration covered by this notice is for website measurement. It does not include advertising personalisation, remarketing or the transmission of contact-form contents to Google Analytics.
You can accept or reject optional analytics when presented with the cookie choices. You can subsequently change your choice or withdraw consent through the website’s Cookie Settings control. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
Cookie Settings provides the current information about the cookies and similar technologies used, including their purposes, providers and durations. You can also remove cookies through your browser settings.
Further information is available in Google’s Privacy Policy and Google’s information about Analytics cookies.
6. Who Receives Personal Data
Personal data may be accessed by authorised Movicom Srl personnel whose responsibilities require it.
Where necessary for the purposes described above, we use service providers for website hosting and maintenance, business email, customer relationship management, IT support and analytics. Providers acting as processors are subject to appropriate data processing agreements and may process personal data only in accordance with our instructions.
Information may also be disclosed to professional advisers or competent authorities where necessary to meet legal obligations or protect legal rights.
If your enquiry requires the involvement of a separate regional company or production partner, we will explain the relevant recipient, purpose and data protection arrangements before forwarding your personal information. Information is not shared with every company or partner listed on the website simply because you contact us.
7. International Transfers
Our website hosting, business email and customer relationship management services are located within the European Economic Area (“EEA”).
Google Analytics may involve processing by Google entities or subprocessors outside the EEA, including in the United States. An EEA-based service provider does not necessarily mean that every subsequent processing operation takes place within the EEA.
Where such transfers occur, the applicable arrangements must satisfy Chapter V GDPR. Depending on the recipient and the transfer, these may include an applicable European Commission adequacy decision or Standard Contractual Clauses, together with additional safeguards where required.
Google’s applicable data processing terms describe its international transfer arrangements. You may contact us to request information about the arrangements relevant to your data and a copy of applicable safeguards, subject to necessary redactions.
8. How Long We Keep Personal Data
We retain personal data only for the period necessary for the relevant purpose:
- Enquiries that do not result in a contract: up to 12 months after the last substantive communication, unless a specific legal obligation or an existing dispute requires longer retention.
- Contract-related information: for the duration of the business relationship and subsequently for applicable statutory retention or limitation periods. Relevant records may be retained longer where necessary for an ongoing legal claim.
- Routine technical and security logs: up to 30 days. Records relating to a detected incident may be retained until the investigation and any necessary follow-up are completed.
- Google Analytics user-level and event-level data: 14 months, with the option to reset retention on new user activity disabled. This setting does not control the retention of all aggregated Analytics reports.
- Cookie preference and consent records: for as long as necessary to apply your choices and demonstrate compliance with consent requirements, taking account of applicable limitation periods.
When retention is no longer justified, the relevant personal data is deleted or irreversibly anonymised. Restricted backup copies are removed through the applicable backup rotation process and are not used for ordinary business purposes.
9. Your Data Protection Rights
Subject to the conditions and exceptions in the GDPR, you have the right to:
- Access your personal data and receive information about its processing.
- Request correction of inaccurate data or completion of incomplete data.
- Request deletion of your personal data.
- Request restriction of processing.
- Receive data you have provided in a structured, commonly used and machine-readable format, and request its transmission to another controller, where processing is automated and based on consent or a contract.
- Object, on grounds relating to your particular situation, to processing based on legitimate interests. We will then stop that processing unless we demonstrate overriding compelling legitimate grounds or the processing is necessary for legal claims.
- Withdraw consent at any time where processing is based on consent, without affecting the lawfulness of earlier processing.
To exercise these rights, email info.italy@movicom.tv. We may request additional information where reasonably necessary to verify your identity. Please do not send a passport copy unless we specifically explain why it is necessary.
We respond without undue delay and normally within one month of receiving your request. Where permitted by the GDPR, this period may be extended by up to two further months because of the complexity or number of requests. We will inform you of an extension and its reasons within the initial month.
Requests are normally handled free of charge. Any permitted fee or refusal will be explained in accordance with the GDPR.
You also have the right to lodge a complaint with a supervisory authority, particularly in the country of your habitual residence, place of work or the alleged infringement. In Italy, the authority is the Garante per la protezione dei dati personali. You do not have to contact us first to exercise this right.
10. Security and Automated Decisions
We apply technical and organisational safeguards appropriate to the nature of the personal data and the risks of processing. These include controlled access, confidentiality requirements and measures to protect systems and communications. No internet transmission or storage system can provide an absolute security guarantee.
The website processing described in this notice does not involve decisions based solely on automated processing that produce legal effects or similarly significantly affect you.
11. External Websites and Changes to This Policy
The website contains links to external websites, including regional partners and service providers. Their processing is governed by their own privacy notices. This Privacy Policy covers processing for which Movicom Srl is responsible.
We may update this Privacy Policy to reflect changes in our services, processing activities or legal requirements. The current version and its update date will be published on this page. Where required, we will provide additional notice or obtain fresh consent before introducing a new consent-based purpose.
